TERMS OF USE:

Let it be known that the following constitutes a binding agreement ("Agreement") between the undersigned party, hereinafter referred to as the "User," and Harihar Language Translator, hereinafter referred to as the "Provider":

1. This Agreement sets forth the terms under which the Provider renders its Services via the mobile application ("Harihar Translation App") to individual Users, including those accessing the Services through their respective Employers. By engaging with the Services, including but not limited to the installation and/or download of the aforementioned mobile application, the User expressly acknowledges and accepts the terms herein. The User warrants that they possess the requisite legal capacity, authority, and control over the mobile device utilized for accessing the Services. Such access is contingent upon adherence to these terms, the intended use thereof, compliance with all applicable laws and regulations, and the exercise of due diligence. Non- acceptance of these terms precludes the User from utilizing the App and accessing the Services therein. In the event of non-compliance subsequent to acceptance, the Provider reserves the right to suspend and/or terminate Services, impose restrictions, or cancel User accounts and access to the App, without prior notification.
2. This Agreement acknowledges that updates and amendments may be made at the Provider's discretion. Such modifications, effective upon posting within the App, require the User's automatic acceptance upon continued use of the Services and the App. In certain circumstances, explicit acknowledgment of updates or amendments may be mandated upon User login, thereby precluding access until compliance is demonstrated.
3. The User acknowledges that any questions or concerns regarding this Agreement should be directed to the designated support channels. Pending satisfactory resolution and subsequent agreement to the stipulated terms, the User is advised to refrain from utilizing the Services. Furthermore, the User acknowledges that the distribution of the App through mobile application marketplaces may entail additional terms, conditions, and usage regulations, distinct from those outlined herein.
4. If you have any questions or concerns regarding these Terms, please contact support at the email provided in the support Section. Do not use the Services until your questions and concerns have been answered to your satisfaction and you agree to abide by these Terms.

ADDITIONAL TERMS

The following terms, and any subsequent amendments thereto, also form part of these Terms of Use:

1. our Privacy Policy;
2. any consents you provided (or that you may provide in the future) when you log into the App; and
3. any amendments, modifications or updates made to the foregoing from time to time.

GRANT OF LICENSE

Subject to your compliance with these Terms of Use, Harihar Translator grants you a limited, non-exclusive, revocable, non-sublicensable, non-transferable license, to access, download and/or install the most current generally available version of the application provided to you as part of the Services solely for your lawful, personal, and other commercial and non-commercial use.

DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS

1. Restricted Use.

1. You may not rent, sell, lease, sublicense, distribute, assign, copy (other than a single copy for your own backup purposes), or in any way transfer or grant any rights to the Services or use the Services for the benefit of any third party.
2. Unless expressly authorized by Harihar Translator, you are prohibited from making the Apps available over a network where it could be downloaded or used by multiple users.
3. You agree that you will not use any robot, spider, other automatic or manual device or process to interfere or attempt to interfere with the proper working of the Services, except to remove our App from a mobile device which you own or control. You may not violate or attempt to violate the security of our Services.
4. You may not modify, reverse-engineer, decompile, disassemble, or otherwise tamper with any Services, or attempt to do so for any reason or by any means. You may not access, create or modify the source code of any Services in any way.

2. Age Requirement.

1. You must be 13 years of age to install or use the Harihar Translation App.

3. Updates.

1. We reserve the right to add or remove any feature(s) and/or function(s) to existing Services. When installed on your mobile device, the Application periodically communicate with our server(s). We may require the updating of the Application on your mobile device when we release a new version of the Application, or when we make new features available to it. This update may occur automatically or upon prior notice to you and may occur all at once or over multiple sessions. You understand that we may require your review and acceptance of our then-current Terms of Use before you will be permitted to use any updated versions of the Services. You acknowledge and agree that any obligation we may have to support previous versions of the Services may be ended upon the availability of updates, supplements or subsequent versions. You acknowledge and agree that we have no obligation to make available to you any updates, supplements or updated version of the services.

4. Access.

1. You must provide at your own expense the equipment, internet connections, devices and service plans to access and use the Apps. If you access an App through a mobile network, your network or roaming provider's messaging, data and other rates and fees may apply. You are solely responsible for any costs you incur to access the Apps from your device.

THE SERVICES AND THE APP.

1. We provide confidential resources through the App (the “Services”).
2. Your access to and use of the App is made available on an “as-is” and “as- available” basis at your sole risk. We do not warrant to you that your access to and use of the App will be uninterrupted or error-free.
3. We may change or cease to offer certain features or programs forming part of the App (the “Services”) from time to time and without notice. We do not warrant to you that any particular content will be available as part of the Services through the App.
4. We reserve the right to change the design, features and/or functionality of the App and we may make available updates or replacement versions of the App. You are not obliged to download any updates or replacement versions of the App, but we may cease to provide or update content to prior versions of the App.
5. To protect the privacy of our users, we do not monitor the content of the Application which is end to end encrypted and the user is therefore responsible for using the Application in a lawful manner and/or for any misuse of the Application for any lawful gain(s).

The Application may only be accessed and used on a device owned or controlled by you for which the Application was designed, so it is your obligation to make sure that you have a compatible device that meets all of the necessary technical specifications to enable you to access and use the Application and its various features.

REGISTERING AN ACCOUNT

1. In order to use the Services, you must register a valid account on the Application and:

1. be at least 13 years old;
2. at all times, be eligible to use the Services pursuant to the terms and conditions stated herein.
3. agree to comply with these Terms of Use for as long as your account is open; and
4. ensure the information in your account is accurate and updated regularly with any relevant changes.

2. You must sign up directly with us using the Application in order to be able to use the Services. When signing up, you must provide:

1. valid and subsisting mobile phone number and E-mail Id.
2. any other information reasonably requested by us as part of the sign-up process.

3. You warrant that all information you provide to us when registering an account is true and accurate. You must advise us if any of the information that you have provided to us in connection with your account changes at any time during the tenure of these Terms and Conditions.

4. We reserve the right in our absolute discretion to refuse to register any prospective User if that prospective User refuses to provide any details requested pursuant to these Terms of Use or we have reason to believe that any details that are provided are deliberately false or otherwise inaccurate.

5. In establishing an account, you must create a username (which can be your mobile phone number or E-mail Id) which must comply with our security requirements. Your account is personal and non-transferrable, and you must keep your conversations confidential at all times. You are responsible for any abuse or misuse of your account and you must immediately report to us any actual or suspected abuse or misuse of your account. We reserve the right to suspend or terminate your account at any time, including for security purposes.

6. You can have only one account; and registration of secondary account shall be a ground for termination of all accounts connected to you.

7. Notwithstanding anything to the contrary in these Terms of Use, if you deliberately provide any inaccurate or misleading information to us, or you conduct or facilitate any fraudulent, criminal, abusive or inappropriate activity using the Application, we may suspend or terminate your Account without notice.

UNINSTALL/ REMOVAL OF APPLICATION

Uninstallation and removal methods vary depending on your device. To uninstall and remove the Apps, please use the application manager provided with your device or consult your device manual for reference. Please remember if you have a paid subscription to an App, uninstalling will not cancel your recurring payments. See our cancellation instructions below for more information.

PURCHASES & CANCELLATION RIGHTS.

Subscriptions.

You may purchase certain Services on a subscription basis. Some Services may offer different subscription levels (e.g., free, pro or premium) or subscription periods (e.g., weekly, monthly, yearly). Payment for a subscription may be processed in-App, through a third-party mobile platform owner (e.g. Apple or Google) or directly through Harihar Translator and its third-party payment Processor.

You may be offered a free trial of a subscription to our Services for a limited period of time. You are free to cancel a free trial subscription via the subscription setting in your Android account, or if you went through one of our websites, by logging in on the applicable website to manage your subscriptions

If you subscribed for our Services by purchasing and installing an App through a third- party mobile platform owner (either through the third- party platform or in-App), you may cancel your subscription at any time by following the Apple App Store or Google Play Store instructions or via the subscription settings in your Android account.

All cancellations will take effect starting at the end of the then current billing period. For example, if you have a monthly subscription that began on the first of the month but cancel mid-month, your cancellation will be effective as of the end of that month. There are no refunds on subscriptions once the charge has gone through for the billing period.

DATA PROTECTION AND PRIVACY

These Terms of Use, as well as our Privacy Policy and (as the same may be amended from time to time) govern our collection, confidentiality obligations, use, disclosure, retention, and destruction of any personal information you submit to us using the App, including any personal information you generated by your use of the Services. Please review and refer to our Privacy Policy as it contains important information you should know about your data and other personal information about you.

You may withhold your consent to our collection, use, processing, disclosure, retention and/or destruction of your personal information by choosing to not register an account and therefore not accessing any of the services. once you have given your consent to us, you may withdraw your consent in whole or in part at any time but any withdrawal of your consent will affect the services that we are able to provide to you, and may limit your ability to use features on the application, if you withdraw your consent entirely we may terminate your account immediately.

Except where prohibited or limited by law, by creating an account and agreeing to these terms of use, you release us from any and all liability arising from our collection, use, disclosure, processing, retention and/or destruction of your personal information pursuant to these terms of use and in our privacy policy.

EXTERNAL LINKS

The Application may provide links to other websites as part of the Services we provide to Users, including for educational purposes. Users should exercise discretion when accessing links to other websites through the Application.

We make no representations concerning operation or content of these external websites and are not responsible for the quality of information on any such external websites or any link contained in such external websites. these links may lead unintentionally to sites containing information that some people may find inappropriate or offensive. these links may also lead to sites that contain inaccurate information, false or misleading advertising, or information that violates copyright, libel, or defamation laws. the services, products, and resources available from these websites are not endorsed in any way by us, nor we endorse any of the sponsors or advertisers on these sites.

AVAILABILITY AND OPERATION OF THE SERVICES AND APPLICATION

1. We will use commercially reasonable efforts to make the Services and App available for use by you for as much of the time as is reasonably possible, but we do not give or enter into any condition, warranty, or other term to the effect that the Services or App are or will be:

1. available all of the time;
2. free from errors, defects, viruses or other destructive elements; or
3. in compliance with any particular standard(s).

2. By creating an Account and using the App, you agree that we will not be liable to you for any unavailability of or defect in our Services or App (however temporary), including due to scheduled maintenance, upgrades, security, legal or business reasons, and/or reasons beyond our control (such as hardware or software failures, other interruptions of internet or telecommunications service).

3. It is your responsibility to implement appropriate information technology security safeguards to satisfy your particular requirements as to the safety and reliability of the App and its content.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in or relating to the Services and the Application (including text, graphics, software, photographs and other images, videos, sound, trademarks and logos) are owned by us or our licensors. You are given a non-exclusive license to use the intellectual property rights concerned only to the extent necessary to enable you to receive the Services and to use the Application in accordance with these Terms of Use. You acknowledge and agree that you do not acquire any ownership of, or other rights in relation to, any such intellectual property rights by virtue of receiving the Services or by using the Application.

OUR LIABILITY.

Except as expressly set out in these Terms of Use, we make or give no representation or warranty as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose or originality of any content of the App, and to the fullest extent permitted by law, all implied warranties, conditions or other terms of any kind are hereby excluded. To the fullest extent permitted by law, we accept no liability for any loss or damage of any kind incurred as a result of you or anyone else relying on the content of the App.

Nothing in these terms of Use shall exclude or limit our liability to you:

1. or fraud or fraudulent misrepresentation; or
2. for any liability that may not, under governing law, be excluded or limited.

You are solely responsible for protecting your private conversations and access to our App and we will not be held liable for any loss or damage that may result from your failure to do so.

We shall not be liable to you (whether such liability arises as a result of breach of contract, negligence, misrepresentation or for any other reason) for any business losses and any liability we do have for losses you suffer is strictly limited to losses which were reasonably foreseeable.

We shall not be liable to you for any loss, damage, liability, cost, claim or expense that you suffers, incurs or pays as a result of the suspension or termination by us of your access to and use of the Services.

CLOSING YOUR ACCOUNT

If you wish to close your Account You may contact our helpdesk with regard to the same. Please note that we may retain information concerning your Account in our records in accordance with our standard practices and in accordance with our Privacy Policy. Closing your Account will not obligate us to delete such information except in due course under our practices and policies. Please note that we may close your account if:

1. You are in breach of terms of use.
2. You cease to be an eligible User with or we reasonably believe that to be the case.
3. You cease to pay for the Paid Subscriptions.
4. For any other reason at our absolute discretion.

CONSENT TO USE OF DATA AND USER REVIEWS

You may agree that we may collect and use technical data and related information including but not limited to technical information about your device, system and Harihar App that is gathered periodically to facilitate the provision of updates relating to app, product support and other services provided to you (if any) by the Harihar Translation Services.

Additionally, if you choose to provide app store reviews or reviews via any social media/ channel, or other similar communication or messaging features or services, such information may be made publicly available, including the public-facing username as it appears with the review. If you prefer that we do not use your app reviews for promotional purposes, you will be able to elect for us not to do so by contacting our helpdesk with regard to the same.

For security purposes, please do not include any password, social security number, payment card or other sensitive information via these features. We have the right, but not the obligation to monitor messages and communications between and among users for security and training purposes. We may, but are not obligated to, remove any content we deem inappropriate.

REFUND POLICY

Payment once made shall not be refunded under any circumstances and any decision in regard to a request made to the Provider for refund shall be solely taken by the Provider.

DISPUTES RESOLUTION

If you have any concern or dispute about the Services on the Application, you agree to first try to resolve the dispute informally by contacting us.

The rights and obligations of the parties pursuant to this Terms of Use are governed by, and shall be construed in accordance with, the laws of India and the place of jurisdiction shall be exclusively in Delhi, India.

You may be subject to other local, provincial or state and national laws. You hereby irrevocably submit to the exclusive jurisdiction of the Courts of India, (place)for any dispute arising under or relating to this Agreement and waive your right to institute.

We shall be entitled to institute legal proceedings in connection with any matter arising under this Agreement in any jurisdiction where you reside, do business or have assets. legal proceedings in any other jurisdiction.
